Please carefully read and review the following TaC before purchasing and using OpenCard.
§ 1. Definitions
- OPENCARD CARD - OpenCard Partnership Program Card entitles its members to receive discounts in participating restaurants.
- The ORGANIZER - OpenCard Ltd., is located at 34 Jozefa Pilsudskiego Ave, 35-100 Rzeszow, Poland.
- TERMS AND CONDITIONS (TaC) - terms pertaining to the possession and use of the OpenCard Membership Card.
- The PARTICIPANT - an individual, who becomes OpenCard membership account holder as described in TaC.
- OPENCARD PROGRAM - Organizer’s partnership program.
- PURCHASE FORM - a document containing Member’s personal details which must be filled out in person, which in return allows the Member to receive discounts for services offered.
- PARTNER - a participating restaurant, which offers discounts for program Members for its services based on partnership agreement with the Organizer.
- ELECTRONIC CARD - an electronic version of the card available after registering it with the OpenCard Card Android and iOS mobile application.
§ 2. General Provisions
- Program participation is under the condition of possession of the OpenCard Membership Card.
- OpenCard Card offers admission for one individual and its benefits are non-transferable.
- The Organizer and the Partner are not responsible for damaged, lost or stolen Card.
- TaC regulates the ownership and use of the OpenCard Membership Card.
§ 3. Terms of possession and use of the Membership Card:
- OpenCard Membership Card can be purchased online at www.opencard.pl or by visiting an authorized seller.
- The Card is available in 12, 6, 3 and 1-month enrollment periods.
- Every individual interested in obtaining the Membership Card is required to fill out a purchase registration form available on www.opencard.pl or fill out a paper version available at participating restaurants.
- Card holder herby agrees to process personal data in order to obtain the OpenCard Membership Card..
- Card holder is dully responsible for informing the Organizer about any contact information changes, such as: home address or email. The Organizer is not responsible for any communication errors with the Member arising from above-mentioned issues.
- Current enrollment fee is set by the Organizer and is published on their website.
- Depending on the Card purchase date and chosen enrollment period the card is valid for 1, 3, 6 or 12 months. Additionally, the Organizer reserves the right to add an additional time period necessary to have the card delivered to the Member. The expiration date is clearly stated on the front of card.
- The OpenCard Membership Card Holder is responsible for activating the OpenCard card or the Promotional Test Card on www.opencard.pl before using it for the first time at participating restaurant.
- 50% OpenCard rebate applies strictly to food. 30% rebate applies to food and alcoholic beverages.
- Rebates available to OpenCard Members cannot be combined with any other “carryout” or “to-go” offers.
- OpenCard Member is entitled to receive rebates from Program Partners which are available on the Organizer’s website in the Find Restaurant tab and on mobile application as well.
- Before using the OpenCard benefits, the Members are obliged to familiarize themselves with all applicable rules and restrictions set forth by the particular participating restaurant. Rules and restrictions of each restaurant are available on the restaurant’s profile page on www.opencard.pl and on mobile applications.
- The Organizer duly notes that each participating restaurant has the right to revoke or change its participation in the OpenCard Program.
- The Organizer is not responsible for any partnership restaurants canceling or changing their participation in the OpenCard program.
- The Organizer, at its option, will keep the list of participating restaurants up to date as much as possible.
- In order to have the rebate honored at the participating restaurant the Member must present the OpenCard Card along with the government identification (ID) to the Partner whose rules and restrictions are available on the restaurant’s profile page on www.opencard.pl and OpenCard mobile application.
- In the absence of Promotional Test Card, in order to receive a rebate the Member must present endorsed OpenCard Card.
- List of participating restaurants is available on Organizer’s website www.opencard.pl and on mobile application.
- Member will be informed about changes beyond the Organizer’s control by email and directly on its website www.opencard.pl and mobile application.
- The Organizer is not responsible for quality and service of OpenCard Partners.
- OpenCard is not liable for Supplier’s obligations the Participant's business partners, as well as obligations of the Participant and (or) Business partners towards the Supplier, both during and after the conclusion of the OpenCard program.
- Any actions aimed at illegally obtaining a service or product, in particular by the use of a counterfeit or stolen card, or use of the card past its expiration date are prohibited and constitute a violation of law and are subject to criminal liability.
- Further resale of Member’s OpenCard on any website regardless of time and means is a strict violation of TaC. Violation of above-mentioned TaC entitles partnership restaurants to refuse to honor rebate. In case of such incident the card holder is not entitled to pursue any rights from OpenCard Sp. z o.o. OpenCard is not liable for any damages arising directly or indirectly due to violation of the TaC.
- Upon theft or loss of the OpenCard Card the holder is held responsible to immediately report the incident to the Organizer.
- Failure to report lost or stolen card to the Organizer will result in accepting no responsibility.
- Loss or destruction of the OpenCard Card by the Member will result in card replacement fee.
- Every Member of the OpenCard Program is obliged to follow generally accepted manners and respect the dignity of Partners.
- The Member agrees to receive an electronic version of the invoice for purchasing the OpenCard cards.
- Promotional Test Card is time-limited (up to 45 days) and single-use (available for new Members only).
§ 4. Final provisions
- The content of the Terms and Conditions are available to general public on the Organizer’s website www.opencard.pl
- By signing the Registration Form the Member fully and unreservedly accepts the TaC.
- Said Terms and Conditions are subject to change on the basis listed below.
- The notice of change to the TaC shall take effect upon being published on the Organizer’s website.
- The Member has the right to cancel the membership within 10 days upon receiving the OpenCard card. Cancellation notice must be sent electronically to the Organizer’s email address. The amount will be immediately reimbursed to the Member’s bank account.
- Member is not entitled to reimbursement if the cancellation notice is filed after 10 days of receipt of the card.
- In case of loss or damage Member’s card can be replaced. OpenCard card replacement fee is 15.00 PLN. In case of BZ WBK Prepaid OpenCard card the replacement fee is 30.00 PLN. Replacement card will bear same expiration date as the original one.
